$3.55 Million ROP settlement
This child was born at 30 weeks gestational age and weighed more than 1200 grams. After discharge the ophthalmologist examined the baby for ROP but failed to appreciate the significance of his findings. The doctor did not order a timely follow-up eye examination and the baby’s eyes passed through the critical treatment window untreated. She is totally blind in each eye as a result of her untreated ROP.

$3 Million ROP settlement
This child was born at 28 weeks gestational age and weighed approximately 1000 grams. He was examined at four weeks of age where early findings of ROP were noted. The hospital failed to inform the parents and failed to schedule a follow-up eye exam before discharge. Several months later the parents questioned whether their baby was following objects with his eyes and an eye exam revealed bilateral blindness.

$2.8 Million ROP settlement
This case was brought against an obstetrician who failed to treat an incompetent cervix and prevent a preterm delivery. The baby was born at 26 weeks gestational age and although her ROP was treated, her Rush ROP Disease did not respond to treatment. The case was based on the theory that if the obstetrician had properly treated the incompetent cervix the preterm delivery could have been avoided or delayed and the baby would most likely not have developed blinding ROP.

$2.72 Million Verdict
This case was brought on behalf of a 30 year old mother of one who lost her vision as a result of a failure to diagnose and timely treat a Sagittal Sinus Thrombosis. The SST was a blockage in the brain that caused a dangerous increase in intracranial pressure. Without treatment the pressure eventually damaged my client’s optic nerves with resulting blindness. A jury awarded $2.4 million plus $320,000 in interest.

$2.4 Million PKU settlement
As with all children born in this country, my client was tested for PKU (the inability to oxidize phenylketonuria) at birth. The lab report came back as positive, however, the report was mislabeled. PKU disease can be treated with proper diet but without proper treatment PKU will lead to severe mental retardation. At two years of age the child began to show developmental delays and the PKU error was discovered.

$2 Million Stroke Settlement
My client had complaints of dizziness and headache for three or four days. A CT scan revealed cerebrovascular disease but the neurologist diagnosed a cold. My client suffered a severe cerebellar stroke which left him with significant disabilities including quadriplegia and the inability to speak.
